This is the License for the Binary Version of the Linux General Ledger and all accompanying documentation and other matter (The Software).By continuing the ordering process you are agreeing to all the terms and conditions of this LINUX GENERAL LEDGER BINARY SOFTWARE LICENSE. If you do not agree to all the terms and conditions of this license, then do not continue with the ordering process.
1. Ownership - Title, ownership rights, and intellectual property rights in and to The Software shall remain with Linux Business Accounting Systems. The Software is protected by the copyright and patent laws of the United States and international copyright treaties. You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software.2. Restrictions - The Software is licensed to you (the Licensee) for your own or your company's use only. You agree to not copy The Software except as is necessary for backup and preservation needs or for additional sites or CPUs for which a license fee has been paid. You may use The Software only on one computer (CPU) for each CPU license fee paid on the Order Form. You may, however, attach any number of terminals to that computer with a different user on each terminal as long as The Software does not reside on that terminal and the appropriate additional user license fees are paid.
3. No Warranty - The Software is being delivered to you AS IS and Linux Business Accounting Systems makes no warranty as to its use or performance. LINUX BUSINESS ACCOUNTING SYSTEMS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL LINUX BUSINESS ACCOUNTING SYSTEMS, ITS PRINCIPALS OR ITS EMPLOYEES, BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, OR FOR ANY CLAIM BY ANY THIRD PARTY. LINUX BUSINESS ACCOUNTING SYSTEMS' SOLE OBLIGATION UNDER THIS WARRANTY IS TO REPLACE DEFECTIVE MEDIA UPON WHICH THE SOFTWARE IS DELIVERED. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT. Some states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or the exclusion of implied warranties or limitations on how long an implied warranty may last, so the above limitations may not apply to you.4. Entire Agreement - You agree that this Software License represents the entire agreement between you and Linux Business Accounting Systems.
5. Governing Law and General Provisions - This Agreement will be governed by the laws of the State of California, U.S.A., excluding the application of its conflicts of law rules.
6. Severability - If any part of this Agreement is found void or unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.
